APPEL A CONTRIBUTION ARJIL 2020-2021

Le champ d’intérêt de l’ARJIL s’étend à toutes les disciplines du Droit international ; il nous éclairera davantage sur les fondements sociologiques (Sociologie du Droit international) et philosophiques (Philosophie du Droit international). L’Annuaire portera aussi sur une diversité de thématiques relatives à la sphère économique (Droit économique international et Investissement international), à la sphère du développement (droit international pour le Développement), à la sphère de l’environnement (Droit International de l’Environnement), à la sphère des droits de l’Homme (Droit international des droits de l’Homme) et à la sphère humanitaire (Droit international humanitaire).

Par ailleurs, une place particulière sera réservée aux questions majeures liées au changement climatique, aux flux migratoires et aux épidémies, qui nécessitent un engagement scientifique et intellectuel de la part des chercheurs en termes de Droit international et en sciences sociales en général.

L’une des motivations capitales qui nous ont guidés dans le lancement de cette initiative concerne l’insuffisance des études mettant en relation le Droit International et les différents problèmes et tensions qui traversent le Monde arabe. L’ARJIL souhaite apporter sa contribution pour répondre à cette pénurie d’études.

Un tel projet met ainsi l’accent sur les diverses préoccupations de portée mondiale qui agitent aujourd’hui un Monde arabe très ouvert sur l’autre.

Le cadre géographique et institutionnel de l’ARJIL sera le Monde arabe. Cependant, nous restons ouverts aux variables internationales et à leurs diverses implications théoriques, ainsi qu’aux transformations en cours sur la scène internationale et les constructions régionales du Droit International (Cas de l’Union européenne par exemple).

Parmi tant d’autres champs d’intérêt de l’ARJIL, nous citons:

Les conditions de publication dans l’ARJIL:

·        Seront acceptées les recherches (non publiées auparavant) fondées sur les normes scientifiques de rédaction et de documentation.

·        Les études et papiers de recherche seront soumis à l’évaluation en double aveugle.

·        Seront acceptées les études rédigées en arabe, en anglais et en français.

Appel à contributions :

L’ARJIL annonce un appel à contributions abordant l’intelligibilité des questions traitées par le Droit International touchant au Monde arabe, celui-ci étant considéré le champ d’intérêt de l’ARJIL.

Dates importantes :

Les chercheurs désirant publier leurs études dans l’ARJIL de 2020-2021 doivent envoyer leurs propositions (format WORD), et y joindre une biographie scientifique de l’auteur (format PDF) dans un délai qui ne dépasse pas le 30 novembre 2020.

 Les études envoyées doivent contenir entre 5000 et 6000 mots (Police : Times New Roman).

Les règles de rédaction :  

·        Les ouvrages : Le nom d’auteur, le titre de l’ouvrage, le nom du traducteur le cas échéant (le lieu d’édition : éditeur, date d’édition).

 

·        Les revues : Le nom d’auteur, le titre de l’article, le titre de la revue, l’édition (le lieu d’édition : éditeur, date d’édition).

 

·        Les ressources électroniques : Ne seront acceptés que les sites électroniques internationalement reconnus (par exemple le site de l’ONU). Doivent être mentionnés : Le titre du site électronique et la date de consultation. l’URL est obligatoire.

 

·        Les références: le chercheur est appelé à être précis dans ses références. L’ordre alphabétique en ce qui concerne leur classement doit être observé.

Mot du Directeur

De nos jours, l’ordre international connaît des changements radicaux, et ce, à travers le dynamisme de la mondialisation, la lutte de pouvoir et de contrôle de l’interdépendance entre les grands acteurs.

Au niveau du pouvoir décisionnel international, nous constatons une faible représentation, voire l’absence totale, des pays arabes qui demeurent subordonnés aux dictats des grandes puissances et sous l’emprise du néolibéralisme. Velléités hégémoniques, anarchie des régimes politiques, enlisement de conflits et absence de stratégies de développement, sont autant de causes qui font perdurer cette situation.

Par ailleurs, le revirement idéologique qui a marqué les  années quatre-vingts du  20^e siècle a donné lieu à  l’avènement de stratégies de développement néolibérales dont les vertus ont mis en valeur dans le cadre des Programmes d’Ajustement Structurel (PAS) et plus tard dans le cadre du consensus de Washington. Mais malheureusement, les résultats de leur application dans la quasi-totalité des pays en développements ont été décevants.

Cet état de fait s’explique, entre autres, par l’incapacité de ces pays à mettre en œuvre les différentes dispositions du droit international, mais aussi à imposer en leur faveur  les  diverses  positions des instances et  juridictions internationales. Un exemple éloquent est celui des dispositions de l'avis consultatif de la Cour Internationale de Justice (CIJ), rendu en  2004, qui atteste l’obligation des Etats de ne pas reconnaitre la situation illicite du mur de séparation dans le territoire palestinien occupé. Le manque de précision sur l’objet de l’obligation des Etats dans l’avis méritait un regard particulier sur  les repères  de ladite disposition. Face à un tel constat qui met des restrictions à l’intervention des pays concernés, les Etats arabes ont tout simplement choisi le statuquo, plutôt que de se mettre autour d’une même table pour discuter des effets de l’avis rendu par la CIJ.

Dans la perspective de  mettre en exergue les rouages de l’ordre international,   résultant d’une confrontation entre la lettre et l’esprit du droit international, ainsi que les rapports de force qui marquent les relations internationales,  nous avons jugé opportun de prendre l’initiative de lancer la "Revue Arabe du droit international". Celle-ci ouvrira certainement  la voie à des réflexions doctrinales et académiques  de qualité sur les différents aspects  du  droit international. Elle servira également à revaloriser la position des pays arabes sur la scène internationale.

A travers ce livre, nous espérons contribuer à décloisonner l’analyse du droit international qui se présente, de nos jours, comme un système normatif en perpétuelle évolution, qui couvre autant les aspects  juridiques et politiques que les aspects  économiques, sociaux et philosophiques. 

Par ailleurs, les réalités de la région arabe ont mis à rude épreuve la pertinence du droit international en sollicitant des analyses approfondies d’un  point de vue juridique et normatif, tout en mettant le curseur sur les défis majeurs qui se profilent dans la région comme les questions climatiques, l’immigration ou encore la précarité.

Nous terminons cette présentation par une citation extraite de l’ouvrage du Pr. Mohamed BENOUNA, professeur  de droit international et juge à la Cour Internationale de Justice: ‘Le droit international entre la lettre et l’esprit, 2017’ : «Le rattachement permanent au principe de réalité est indispensable, qu’ils s’agissent des rapports de force ou des intérêts en présence. C’est ce qui donne substance et actualité à la discipline et permet d’en évaluer la pertinence et les limites».

Dr. Chougrani El Houcine is a professor of International Law and International Relations at the Cadi Ayyad University, Faculty of Law, Economics and Social Sciences, Marrakech.  He is the Director of the Moroccan Observatory for the Future Generations (MOROFUGE) and Member of the International Research Center for Crisis Management. His main research interest centers around International Environmental Law (IEL), and his recent publications have focused on water, climate justice, and the rights of the future generations.   Professor Chougrani is a co-founder and Director of ARJIL.

He is the Founder and Director of the Center for Environment, Human Security and Governance (CERES). He is also Associate Researcher at the UMR ESPACE-DEV, IRD, France. Recently, he obtained a Diploma in Diplomacy and International Environmental Law from the University of Eastern Finland and UNEP. Dr. Behnassi is specialist in environmental/climate change and human security politics and governance with a very substantial publication record. In addition, Dr. Behnassi has organized many international conferences and managed many research projects nationally and internationally.

Professor Abdelaziz Radi received his PhD (1993) in Pragmatics from the Marc Bloch Humanities University in Strasbourg, France.  While preparing his doctoral dissertation, he started a teaching career in France.  He authored two English language manuals:  Speaking Already (2005) and First Steps into English (2007).  He worked on the perception of North Africans in the French & European press and media.  In this regard, he was invited as a guest lecturer to the Center of Refugees Studies, Oxford University, UK.  He gained a Fellowship in 2010 on Civic Education, Citizenship and Leadership at Maxwell School of Citizenship, Syracuse University, N.Y. His research mainly focuses on issues such as citizenship, civic engagement, protest movements, and cultural mediation.   He is currently a business management lecturer at the Faculty of Law in the Economics Department, Cadi Ayyad University in Marrakesh, Morocco.

He is the author of six books, including “World of Walls: Structure, Roles and Effectiveness of Separation Barriers” (2017) and “The State in a Changing World: Nation-State and New Global Challenges” (in Arabic) (2008). He has received a number of international awards and grants, including Fulbright Visiting Scholarship, Research Fellowship at the NATO Defense College in Rome and the Arab Prize in the Social Sciences and Humanities. He is currently interested in separation border barriers, foreign policy analysis, international migration, the Western Sahara dispute, nation-state, and international universities’ rankings.

He is Head of the Centre for International Humanitarian and Operational Law (CIHOL) at the Palacký University Olomouc and member of the Research Centre for Human Rights (Charles University in Prague). Dr. Faix is an international expert and has authored over forty publications in the main areas of his work, i.e. international law on the use of force, law of armed conflict, international organizations, and human rights. He serves as substitute member of the Management Board of the EU Agency for Fundamental Rights.

Aboulkasem Ziani est Professeur de sociologie à la Faculté des Lettres et des sciences humaines de l’Université Cadi Ayyad. Depuis 2014, il est Professeur visiteur à la Faculté des Sciences Religieuses Comparatives (Anvers, Belgique) et Chercheur invité à l’Institut Max Planck pour l’anthropologie sociale. Il est également membre fondateur du laboratoire des sciences sociales et transformations sociétales de l’université Cadi Ayyad. Ses travaux s’inscrivent dans le champ de la sociologie de l’environnement et de la mondialisation, son intérêt s’oriente vers la construction sociale et historique de ces deux thématiques dans le monde arabe : -      Les processus sociaux et les cadres normatifs dans le monde arabe face à la dynamique de la mondialisation ; -      Les dynamiques appropriations sociales aussi bien au niveau local que niveau régional de la dégradation de l’environnement.

خالد القضاوي: دكتوراه في القانون العام مهتم بقضايا الأمن والتنمية، له عدة مؤلفات علمية؛وشارك في تأليف العديد من الكتب المشتركة، وفي العديد من الندوات الوطنية والدولية. وللباحث خبرة ميدانية في مجال البحث العلمي الأكاديمي من خلال تقلده لعدة وظائف في مراكز بحثية، مثل الإشراف على مصلحة التكوين، وتنسيق أعمال اللجنة العلمية، وتحكيم الأعمال   الواردة على مركز الدراسات والبحوث الإنسانية والاجتماعية بوجدة. وهو عضو مؤسس للمركز المغربي للدبلوماسية الموازية وحوار الحضارات بالرباط، وعضو المرصد المغربي  الأجيال المقبلة (MOROFUGE) بمراكش. Khalid El Kaddaoui holds a doctorate in public law, and is interested in security and development issues. He is the author of many several scientific papers and co-authored many books. He has also participated in many seminars, either nationally or   internationally. The researcher El Kaddaoui has gained a broad field experience in the field of academic scientific research through serving in many academic organizations such as the supervision of the training services and the coordination of the work of the scientific committee, as well as the evaluation of the scientific research received by the center of Human and Social Studies and Research in Oujda.  He is also a founding member of the Moroccan Center for parallel diplomacy and the Dialogue of Civilizations in Rabat, and a member of the Moroccan Observatory for Future Generations in Marrakech (MOROFUGE).

الدكتور رامي أبو شهاب كاتب وناقد متخصص في النقد الأدبي والدراسات الثقافية، وخطاب ما بعد الاستعمار. يعمل محاضراً في جامعة قطر. حاز على جائزة الشيخ زايد للكتاب لعام 2014 عن كتابه «الرسيس والمخاتلة خطاب ما بعد الكولونيالية في النقد العربي المعاصر»، كما أصدر عدداً من الكتب أهمها: «في الممر الأخير سردية الشتات الفلسطيني» عام 2017، وكتاب «الأنوات المشوهة» 2019، كما نشر عدداً من البحوث الأكاديمية. يكتب مقالة أسبوعية في صحيفة القدس العربي بلندن من عام 2014، وهو عضو هيئة تحكيم عدد من المسابقات الثقافية والأدبية. له مشاركات في مؤتمرات وندوات علمية في عدد من الجامعات والمراكز البحثية في كل من قطر، وكمبريدج، وأكسفورد، وعمان، وأبو ظبي، وكينيا، والبحرين، وغيرها.   Dr Rami Abu Shehab specialized in literary criticism, cultural studies and post-colonial discourse. He currently works as a lecturer in Qatar university. He received the Sheikh Zayed award (2014) for the book "arrasīs walmaḳātla: (exordium and deceit): a postcolonial discourse in contemporary Arab criticism".  He has published more than eight books, one of which is a book entitled "in the last passage, the narrative of the Palestinian diaspora". He writes a weekly article in Al-Quds Al-Arabi newspaper since 2014, Rami, participated in many conferences and seminars in the Universities of Qatar, Cambridge, Oxford, and in many countries such as the UAE, Jordan, Kenya, Kuwait, Bahrain, Greece and others. He was also the member of jury in many literary competitions.

Dr. Sania Faisal El-Husseini, an international relations  professor in the Arab-American University in Palestine and a writer and researcher who has published numerous of political articles and research papers. El-Husseini worked with the Palestinian National Authority for more than two decades and held informative and diplomatic positions.
